Show Your Colours Day 2026
Fundraising Terms & Conditions
These Terms & Conditions apply to all individuals, schools, organisations and groups (“Fundraiser”) registering to conduct fundraising activities in support of Show Your Colours Day 2026 on behalf of Cowboys Charity Limited trading as Cowboys Community Foundation (“Foundation”, “we”, “our”).
By submitting a registration to fundraise, you agree to be bound by these Terms & Conditions.
1. Approval to Fundraise
1.1 All fundraising activities are subject to approval by the Foundation.
1.2 Upon approval, the Foundation will issue an Authority to Fundraise confirming the approved activity.
1.3 The Authority to Fundraise is valid only for the approved activity and timeframe specified and may be withdrawn at any time at the Foundation’s discretion.
2. Nature of the Activity
2.1 Fundraisers are authorised to conduct fundraising activities consistent with Show Your Colours Day 2026 (e.g. gold coin donations and online donations).
2.2 Any material changes to the nature of the activity must be approved in writing by the Foundation.
3. Compliance with Laws
3.1 The Fundraiser must comply with all applicable Commonwealth, State and local laws and regulations.
3.2 Where required, the Fundraiser must obtain any necessary permits, licences or approvals for the activity.
3.3 The Foundation is a registered charity with Deductible Gift Recipient (DGR) status (ABN 89 603 728 427).
4. Financial Management and Remittance
4.1 All funds raised must be remitted to the Foundation within 14 days of the conclusion of the activity.
4.2 Funds must be deposited in accordance with the instructions provided in the Authority to Fundraise.
4.3 Funds raised on behalf of the Foundation must not be applied to any other organisation or purpose.
4.4 Deposits of fundraising proceeds are not tax-deductible.
4.5 Individual donations made directly through the official online donation form will receive an automatic tax receipt.
5. Costs and Expenses
5.1 The Foundation is not responsible for any costs, expenses or liabilities incurred in connection with the fundraising activity.
5.2 The Fundraiser is solely responsible for all expenses associated with conducting the activity.
6. Independent Activity
6.1 The fundraising activity is conducted independently by the Fundraiser.
6.2 The activity is not organised, managed, supervised or controlled by the Foundation.
6.3 The Foundation’s public liability and personal accident insurance policies do not extend to or cover the Fundraiser, its staff, volunteers, participants or third parties involved in the activity.
7. Insurance and Safety
7.1 The Fundraiser is responsible for ensuring that appropriate insurance coverage (including public liability and personal accident insurance where applicable) is obtained prior to the commencement of the activity and maintained for its duration.
7.2 The Fundraiser is responsible for ensuring the safety and legality of the activity, including implementing appropriate safety protocols and emergency procedures.
8. Limitation of Liability
To the fullest extent permitted by law, the Foundation will not be liable for any injury, loss, damage, claim, liability, cost or expense arising out of or in connection with the fundraising activity. The Fundraiser conducts the activity at its own risk and assumes full responsibility for the planning, organisation and execution of the activity.
9. Use of Supplied Promotional Collateral
9.1 The Fundraiser is permitted to use Cowboys Community Foundation promotional collateral supplied by the Foundation solely for the purpose of promoting their Show Your Colours Day fundraising activity.
9.2 Supplied collateral must not be edited, altered or adjusted in any way without prior written approval from the Cowboys Community Foundation.
9.3 Promotional collateral may only be used in connection with the approved activity and must not be used in a manner that is misleading or inconsistent with the purpose of Show Your Colours Day.
10. Sponsorship and Conflicting Partners
10.1 The Foundation may decline to promote or acknowledge sponsors, donors or partners associated with a fundraising activity where those entities conflict with existing Foundation or Cowboys Group partnerships or policies.
10.2 Conflicting partners may include, but are not limited to, entities operating in the following categories:

Automotive sales, manufacturing, servicing or repair

Motor vehicle rental

Mobility services relating to motor vehicles

Finance or insurance relating to motor vehicles

Coal mining
-
Beer, cider, alcoholic ginger beer or alcoholic seltzer
10.3 The Foundation retains sole discretion in determining whether a conflict exists.
11. Promotion and Publicity
11.1 The Foundation may, at its sole discretion, promote or acknowledge fundraising activities through its communication channels.
11.2 The Foundation is under no obligation to promote, publicise or provide coverage of any fundraising activity before, during or after the event.
12. Revocation
The Foundation reserves the right to withdraw approval to fundraise at any time where these Terms & Conditions are breached or where the activity may adversely affect the reputation, partnerships or operations of the Foundation.
13. Privacy
Personal information provided during registration will be used by the Foundation for the purposes of administering Show Your Colours Day and related communications, in accordance with the Foundation’s Privacy Policy.
14. Acceptance
By submitting a registration to fundraise, you confirm that you have read and agree to these Terms & Conditions and understand that your fundraising activity is subject to approval and the issuance of an Authority to Fundraise.
15. Photography, Social Media and Promotional Use
15.1 The Fundraiser acknowledges and agrees that the Foundation may share, repost or otherwise publish social media content created by the Fundraiser in connection with Show Your Colours Day, including tagging or acknowledging the Fundraiser where appropriate.
15.2 The Fundraiser grants the Foundation permission to use photographs, videos and other content voluntarily provided to the Foundation for the purposes of promoting Show Your Colours Day and the Foundation’s charitable activities.
15.3 Where photographs or videos include identifiable individuals, the Fundraiser confirms that it has obtained appropriate consent from those individuals (or from a parent/guardian where required) prior to providing such content to the Foundation.
15.4 The Foundation may contact the Fundraiser to seek additional permission to use photographs or content in future Show Your Colours Day campaigns or related promotional materials.
